SMS Messaging Terms & Compliance

1. Program Description:

This messaging program sends appointment confirmation and reminder messages to customers who have booked an appointment with Advanced Chiropractic Training LLC, Inc through our website at https://www.rapidsuccesstraining.com/, or via our scheduling forms, and have explicitly opted in to receive SMS notifications. Opt-in is collected via web forms with a dedicated checkbox for SMS consent. Messages include scheduling confirmations, appointment reminders, rescheduling updates, and customer support communications.

2. Cancellation Instructions:

You can cancel the SMS service at any time. Simply text "STOP" to the same number that sent you messages. Upon sending "STOP," we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially, and we will resume sending SMS messages to you.

3. Support Information:

If you experience issues with the messaging program, reply with the keyword "HELP" for more assistance, or reach out directly to or call (831) 480-0708 during business hours.

4. Carrier Liability:

Carriers are not liable for delayed or undelivered messages.

5. Message & Data Rates:

Message and data rates may apply for messages sent to you from us and to us from you. Message frequency varies based on your service usage and appointment schedule. For questions about your text plan or data plan, contact your wireless provider.

6. Supported Carriers:

Our SMS program works with all major U.S. wireless carriers, including AT&T, T-Mobile, Verizon, Sprint, and most regional carriers.

7. Age Restriction:

You must be 18 years or older to participate in our SMS program.

We comply with all applicable laws and regulations, including the Telephone Consumer Protection Act (TCPA) and CTIA guidelines, regarding the use of SMS communications.

This Confidentiality & Intellectual Property Agreement (“Agreement”) is entered into by and between the undersigned participant (“Participant”) and Rapid Success Chiropractic Training (“RSCT”), owned and directed by Dr. Mark S. Kimes, D.C. By signing this Agreement, Participant acknowledges, agrees, and covenants as follows:

1. Definition of Confidential Information

For purposes of this Agreement, “Confidential Information” shall mean all training materials, scripts, manuals, protocols, documents, systems, videos, and all other proprietary or intellectual property provided by RSCT, whether written, electronic, oral, or otherwise. Confidential Information expressly includes, without limitation, all information marked or unmarked as confidential that is made available to Participant through RSCT.

2. Ownership of Materials

All RSCT content, including Confidential Information, is and shall remain the sole and exclusive property of Dr. Mark S. Kimes, D.C. Nothing in this Agreement shall be construed as granting any license, rights, or ownership to the Participant, other than the limited right to use such materials for personal training within RSCT.

3. Non-Disclosure & Use Restrictions

Participant agrees to maintain the strict confidentiality of all Confidential Information. Participant shall not disclose, copy, reproduce, distribute, adapt, sell, license, or use such information for any purpose other than training within RSCT, without the prior written consent of Dr. Mark S. Kimes, D.C. Any unauthorized use constitutes a material breach of this Agreement.

4. Remedies for Breach

Participant acknowledges that any breach of this Agreement will cause irreparable harm to RSCT and Dr. Kimes, for which monetary damages may be inadequate. Accordingly, RSCT shall be entitled to: (a) immediate injunctive relief to prevent further unauthorized use or disclosure; (b) recovery of actual damages; (c) liquidated damages in the amount of not less than twenty-five thousand dollars ($25,000) per violation; and (d) reimbursement of attorney’s fees and court costs incurred in enforcing this Agreement.

5. Compliance with Laws

Participant agrees that it is their sole responsibility to comply with all applicable federal, state, and local laws, as well as their professional chiropractic licensing board regulations, prior to implementing any procedures, systems, or practices introduced through RSCT.

6. Governing Law & Venue

This Agreement shall be governed by, and construed in accordance with, the laws of the State of California. Any disputes arising out of or related to this Agreement shall be subject to the exclusive jurisdiction of the state and federal courts located in Monterey County, California.

7. Acknowledgment of Understanding

By using thid website, Participant acknowledges that they have carefully read, fully understand, and voluntarily agree to the terms of this Agreement. Participant affirms that they are legally competent to enter into this Agreement.
